My 17 year old son was driving his 2003 Ford Explorer, when he was hit by another vehicle. My son was approaching a stop light and traveling between 3-5 mph....The vehicle that struck him was a company work vehicle. The work truck was pulling out of a parking lot when he hit my son. His estimated speed was also 3-5 mph. There were no injuries at all, and there was no medical treatment sought. This all happened on April 10th 2011. It was found that driver of the work truck was at fault for inattention. Honestly, this guy was super nice and walked my son through the process of calling police etc til I could get there....Now dealing with the Companies insurance carrier has been a headache!!!! here is the basic timeline....Explorer still drivable....Had to wait 10 days for police report....contacted Company that owned work truck, and they forwarded me to their insurance co....Was advised to seek several estimates, and fax them over....Faxed over estimates to adjuster. All estimates exceeded 5k....Stated she would have to contact an adjuster from local area to work this. Local adjuster came out. Estimated damages to be 3300.00. Insurance Company sent me check for 3300.00 and advised me when vehicle repaired, auto shop would need to work with adjuster on any additional repairs and costs. Explorer was in shop 30 days before finally being totaled. Local adjuster was horrible to work with, did not communicate with body shop, etc. I finally contacted the insurance company, and told them I refused to deal wither contracted adjuster etc. Now that the vehicle has been totaled, they don't want to pay what I think is fair. The insurance company wants to settle for $6928 plus $367 for taxes. Clean retail for the Explorer is $8100. This is for my area. I have been car shopping for 2 days straight. can't find anything comparable with the money they gave me etc. I have taken off work to deal with this etc, been going on for 2 months plus, and Iam worn out with it all...All I want is for my kid to be back in a safe reliable vehicle. The insurance company did provide a rental car. I'm looking ahead into the future a bit but in about a year i will be an E3 in the USAF. I will be bringing home about 1700 a month before taxes, so about 1300-1400 after taxes. I only have about 100 a month of bills and obviously live for free(housing and food). I was wondering, how much of a new car can i finance through a dealership. I have about 1000-1100 after i set aside some money into the bank. So that leaves me about 1000 a month that i could set aside to car, and insurance. I know my insurance will be pretty high, but i was wondering if anyone has any first hand experience as to how much of a car i'd get approved for. BTW: I have good credit, i dont have anything big on my credit report, but ive had credit cards, and cell phone, and furniture and insurance payments for about 3 years, and never had any problems with payments. So my credit is good with what i have, but i dont really have anything big so i would need a codigner if i were to try and get a car today. Ok, made my decision, going with the new 2007 Mazda 3 S (with the 2.3 ltr engine and all that good stuff...not really sure on the sunroof though, it's kind of pricey) My question...s are: 1. ok. So few days ago, I got into a car accident. I was driving down the highway simply just going straight. All of a sudden, this SUV crashed into me from my left lane and knocked off my side-view mirror & left some marks on my left front door. At that time of the being, I was so shocked because all I did was just go straight & I guess the car next to mine was trying to make a lane change but he wasn't fast enough to advance me. so instead, he bumped into me and realized what he's done then went back to his lane. after the accident, we both exited out from the highway & parked our cars on the side road because that's where the other car led me. I was driving alone at that time & I was so scared because it was my first time getting into this kind of an accident. I quickly tried calling 911 & told the 911 lady to send me a police. But she just asked if there was any injury & I said no then she just told me to exchange the insurance. How rude of her. Not to be mean, but I was little scared of the mexicans b/c the area I was in at the moment was really ghetto. so then I took some photos of the damages and exchanged the insurance company. The guy kept telling me in bad English that he was ahead of me so it's my fault. and I told him that I didn't even move & he was the one changed the lane without even checking to see if it was clear. but he couldn't really speak english well or he didn't even want to listen to me. so I left like that with my sideview mirror dangling next to me. *sigh* this isn't the end of the story yet. I claimed his insurance company which ive never heard of. They said that he's telling them I was the one who hit their car. which made NO SENSE. I even have a picture of their car bumper's mark on my side of the car door which proves that there's no way I hit their car and left a mark on mine and broke my own side view mirror and left THEM no damages. His car was clear with one inch scratch on the side which was made when he hit my car after bumping into me with his bumper and quickly turning back into his own lane. I can't even believe how he can lie about this kind of stuff. I feel so mad that there're ppl like him existing!!! It's so frustrating to see the liar defending himself. His Insurance company didn't even try to look at my car & told me that they are sorry & they can not help me b/c their customer said he didn't do it. What should I do in this situation? I have no witness, there wasn't any police there at the time because they wouldn't send me any which is SO WRONG of them to do. I want to sue 911 people. grr. How can I possibly prove them that I have no faults and they should repair my damn side view mirror?!?!?! What can I do?

Car Insurance Question?

Hey all. Recently, a car ran into my legally parked car early in the morning. When I found my car hit, strangely, the other car was still there with their lights on and keys in the ignition. It appeared whomever was driving fled. Fortunately, when the police was called, one of the officers found insurance information for the car that hit mine. We took the make, model, year, and licence plate numbers down on the report. The officers left, however I'm not sure if they are going to attempt to search out the registered owner or not. Guess I could call to see if they are or not. Anyway, I then had the other car towed away and mine towed to a nearby auto body shop. They gave me a preliminary estimate for repairs. I then used the car insurance that was found in the other car, called and filed a claim. The same day the insurance I called had an insurance adjuster/appraiser come look at my car. They considered the damages to notably exceed the first estimate, and considered it 'totaled'. Now, the other car's insurance is attempting to contact the registered owner. They mentioned that if there is difficulty in reaching the owner, the insurance to blame may deny making a reimbursement/compensation payment for my damages. Should I contact the police to see if they've investigated the person? I then later called my own insurance and notified them of what happened in its entirety. Now...if my claim is denied by the at fault person and their insurance, is their any consolation for me? Shall I hire a lawyer and sue in small claims or civil court (for damages/rental car/lawyer fees) since the damages estimated are borderline ~$5,000 +/- 1,000? Could this be a successful alternative if their insurance refuses to help me out? Or should I bite the bullet and go through my own insurance...risking an increased premium for something that was not my fault? Thank you for any advice.

Truck hits curb due to icy road..Damage is extensive. Will insurance pay? ?

I was heading down a hill; the road was icy. The truck wasn't stopping properly. It slid into a curb; damaged the wheel (rim). Now, the truck swirves to the left when I drive. I was rear-ended back in March of 2012. I was at a complete stop on the freeway and the guy hit me going about 30 mph. The force of him hitting me pushed me into the person in front of me, and that pushed them into the person in front of them. There was no visible damage to the cars in front of me and they left without leaving or taking any information. Now my issue is: When I tried calling the person's insurance company, the insurance adjuster told me that because there were 2 other people involved and they did not leave any information that they cannot give me coverage because the guy who hit me has a very low coverage rate and if the other two people called to get money they wouldn't be able to pay it. And that I have to wait 2 years before I can recieve any payment for the damage to my car. I got into a car accident a week ago, a truck driver backed into me while I was just stopped at a stop sign. Now the choices they are giving me are that they'll take the car and give me $1700 (which won't be enough to get another car), or let me keep the car and give me $1200 (which won't be enough to repair it). I think this is really unfair since the accident wasn't my fault at all and now I'm being told I'm going to have to pay to either get a new car or fix my old one out of my own pocket, but I've tried arguing with them to raise the amount they're going to give me and they say they're not legally required to give me any more money than what my car was worth. Is there ANYTHING I can do? I'm a poor college student and really have no money to be spending on something that I couldn't help :(

hi my problem in a nutshell is my vehicle was hit in the rear while it was parked, when i confronted the driver we had an argument and the police were called no offences were committed and the police left after me and the other driver exchanged names and addresses. While I was at University, I was driving innocently along when I realized I didn't have my lights on. At that PRECISE MOMENT, I saw blue flashing lights behind me and the police pulled me over. Then after all that he asked for my car insurance documentation and driving lisence and I said I didn't have any on me except my lisence. He looked at my lisence, wrote down some information and gave it back to me. He then said ''do you realize it is an offence not to carry your car insurance documents with you when asked to produce them at the roadside?''. Again I apologized and said that I had no idea that this was the case. He then gave me five days to produce my photo and counterpart driving lisence and car insurance documents at the local police station or I would be arrested for failing to produce documents on demand. He then asked me to provide a testimony which would be read in court if I didn't produce the documents and so I said ''I'm terribly sorry for any inconvenience''. He then let me out. Suffice to say, the next day I took my documents to the police station for inspection. Is this standard proceedure?

My buddy is suing my insurance company, what could happen?

Ok, So a little over a month ago i was involved in a car accident with a friends car. It was and 1 hr and 30 min drive. My friend said he was tired and drunk, telling me to drive( I was sober) so i did. I did tell him I didn't want to drive because his car was manual(which i can drive, but i've been driving auto for 4 years now. On the way home I fell asleep at the wheel and the car was totaled. None of us were injured, I was good he was good. We did the police report called our insurances. His paid him for his car. Two weeks later he's calling me to come-over to talk. I get bombarded by his family for 2hours basically saying they need money for this and that. The claim was already settled but he insisted i called my insurance company and see if they can give them money because they used the money they got from there insurance to pay off the car(worth about 5 grand) I talked it over with mom because im under her insurance and she said its sounds shady. She calls the insurance company and said dont give him a dime. Insurance is to make you whole again not better then you were. I explained to him numerous times and a week later my mom calls me at work and says gieco called and my friend is suing them. she also said he has a lawyer. He's suing for bodily injury! My told me not to stress it but it bothers me so much. He definitely doesn't deserve anything and especially being in perfect healthy condition. In the accident if you wanna get technical i took all the hits. I know him, my insurance company doesnt. its not right for him to be compensated for some injury that doesn't exist. Whats gonna happen? does he have a chance. the claim opened up is for $25,000 or more. this kid goes out clubbing and partying every weekend and this is how he lies? any input is appreciated. thanks again..

Someone else hit my car while it was parked. It was very cut-and-dry. I got a police report, the officer talked to the driver. It states that my car was legally parked and the other driver is at fault. The damage is minor rear bumper damage, nothing too terrible. I filed with his insurance company, and after a lot of frustrating phone tag, an insurance adjuster came out and wrote me an estimate for $450. I had an adjustment for $734 from the local body shop for my make of car, and I showed it to him. I expressed my dissatisfaction with this estimate, and he said the body shop would settle with the insurance company directly for costs in excess of the estimate. $300 is a little much. Since it's minor damage, I think the body shop will probably take the money and do a shoddy job on the car. It's my understanding they are supposed to repair my car to pre-accident conditions. I got another estimate for $745 this weekend. I can't get it fixed for $450. What are my options? (cont'd)

My agent asked for photos, and a letter from my parents with what they thought the worth of the car was, signed saying it was a gift. So, that's what we gave him. I had State Farm insurance. They raised my rate...I cancelled. After I cancelled they drafted my account for the amount due the following month. So I paid the new insurance and State Farm. I requested a refund for the amount drafted. They sent me a check for a little less than half of what they charged me. So my friend and I were out driving his car and when he got out at a store, I hopped in the driver's seat. I have a class 5 license, so it's all legal there. We weren't speeding or doing anything illegal, we had nothing to hide, so everything was legit. However, pulling out of a four-way, an officer pulled us over because our tail lights were busted. Of course, I had no idea and basically the officer just issued a warning to my friend (he's the owner of the car, so he did most of the talking). There was nothing but politeness and courtesy exchanged in the end we just drove straight to the party we were headed to. A guy ran into me. All he did was pull off a side mirror. I can't get his insurance to replace it directly. They said he has to file the claim. He has yet to do so and the contact number I have for him is bad. So I was told if I go through my insurance they can file the claim to his insurance for me to get it paid. They told me I could not go through my health insurance that it has to be through my car insurance. It turns out I have herniated discs and now my doctor has referred me to see an orthopedic surgeon but, I do not feel that the car accident was the cause of the herniated discs. This past weekend I get a knock at the door from some neighbors during a storm telling me that I should move my truck out of the street. I walk outside and see that my truck is sitting in nearly four feet of water. The water level rose up to cover the seats and nearly reached the dashboard. We put it in neutral and pushed it down the street so most of the water ran out. We used towels to get out what we could that night. I didn't try to crank it, and I unhooked the battery cables. When I tried to crank it about 18 hours later it would not start. My question is, can I sue the city for the flood damage to my truck since their sewer drainage system was responsible for the localized flooding on my street? Can they be held responsible for this? Or will I just have to settle with what the insurance company will give me for the truck since it is undoubtedly totaled? I have already paid about $19500 on the truck, but I still owe about $8600. The answer seems to be to eliminate most of the unnecessary insurance and shrink it to only what is required. That along with serious tort reform would eliminate much of the red tape and cost. The person who abuses their things pays more to replace and fix them. Same thing with the fat people, who suck up most of the insurance money the rest of us pay.. I was driving out of a parking garage and took a turn too tight and my door scraped a parked car's bumper. it scraped the paint on the left side of their bumper-about the size of a football. it looks like it can be buffed out. but on the top of the scraped part there is a broken part about the length of my forearm-not broken exactly, it is a length of spiderweb-cracks in the plastic. My car insurance company had increase my insurance by 2 folds (103%) increase. I contacted the company, enquired about this increase. But they said they cant do anything about it, If I want I can raise this with the customer service chief and chief executive. I wrote them a letter stating it was ridiculous amount of money, they asking me to pay. Also clearly brought to their notice, that I have a clean history, no claim, paid insurance on time, no accidents, and I have no claim discount of 7 years in total. I ask because the other day I was browsing on here and long story short, there was a woman who got into an accident that she claimed was not her fault but proceeded to say that she didn't have insurance and wanted to know what would happen. I bought a car last night and am picking it up today in Nova Scotia. I called around to a number of companies for insurance and got a quote that seemed reasonable. I went down today and signed the paperwork and was given the temporary insurance card and they faxed paperwork to the dealership and the dealership to them and it is all worked out. However I got a call back a few hours later from another broker quoting me a lot less. I had her verify with the company and they said yes. But I have already signed the other stuff. The one I have now is going to be monthly and the first payment should not come out till about the 15th and be the first and last payment for the month. if I switch and they have already taken the payment do I get the last month back? I am a 40 year old woman who is taking my driving test next week. I have run through some quotes for a car (nothing flash or sporty) and the cheapest I can find is 1450 fully comp. Why shouldn't everybody pay for his own protection? For example, if I pay $150/mo for car insurance, and if someone hits me who has no insurance and no money, then my car will look terribly even though I kept the law. This doesn't sound fair to me.
